Welcome to TasteFit. These Terms of Use ("Terms") are a binding agreement between you and Guch Inc. ("Guch," "we," "us," "our") governing your use of the TasteFit mobile application, the guch.ai website, and related services (together, the "Service").

PLEASE READ THESE TERMS CAREFULLY. SECTION 14 DISCLAIMS WARRANTIES AND SECTION 15 LIMITS OUR LIABILITY. SECTION 18 REQUIRES YOU TO CONTACT US BEFORE FILING SUIT.

1. Your agreement to these Terms

By creating an account, or by clicking or tapping a button indicating your acceptance, you agree to these Terms. Our Privacy Policy is a separate document that describes how we handle information; it is referenced here for your convenience and does not modify these Terms. If you do not agree to these Terms, do not use the Service.

The Service is operated from the United States and intended for use by United States residents. We make no representation that it is appropriate or available elsewhere.

2. What TasteFit is — and what it is not

TasteFit is a food discovery and recommendation service. TasteFit does not prepare, handle, inspect, certify, supervise, serve, sell, or deliver food, and is not a party to any transaction between you and a restaurant.

TasteFit is not an allergen-safety service, a medical service, a nutrition service, or a food-safety authority. Nothing in the Service is medical, nutritional, dietary, legal, or other professional advice.

Unless expressly stated otherwise, the Service is not certified, approved, endorsed, or verified by the U.S. Food and Drug Administration, the U.S. Department of Agriculture, any state or local health authority, or any medical, nutritional, or regulatory organization.

3. Eligibility and your account

You must be at least 13 years old to create an account or use the Service. By using the Service, you represent that you are 13 or older and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Contact us at legal@guch.ai if you believe your account has been accessed without permission.

You may delete your account at any time at https://www.guch.ai/delete-account.

4. Fees

The Service is currently offered free of charge. If we introduce paid features in the future, we will disclose the price, billing frequency, renewal terms, and cancellation method clearly and separately before you are charged, and we will obtain your affirmative consent.

5. Your content and the license you grant us

You retain ownership of the content you create on TasteFit, including your reactions, notes, photographs, reviews, and Taste Champion contributions ("Your Content").

By posting Your Content, you grant Guch a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, publicly display, and distribute Your Content, and to use it to operate, improve, and promote the Service, including to develop, train, and operate TasteGraph™ and the TasteScore. This license also covers your public display name in connection with Your Content.

This license ends when you delete Your Content or your account, except that: (a) copies in routine backups may persist for a commercially reasonable period; (b) Your Content may remain visible where others have already shared or saved it; and (c) we may continue to retain and use information derived from Your Content in de-identified or aggregated form that does not identify you and cannot reasonably be used to identify you, including as an input to TasteGraph.

You represent that you own or have all necessary rights to Your Content and that it does not infringe or violate the rights of any third party.

6. Community contributions, Taste Champions, and endorsements

The Service displays content contributed by users, including reviews, comments, photographs, reactions, and endorsements ("User Content"). User Content reflects the personal opinions and experiences of the individuals who submitted it. It does not reflect the views, endorsement, verification, or recommendation of Guch.

We do not verify the accuracy, completeness, or reliability of User Content — including statements about ingredients, allergens, preparation methods, or dietary suitability — and assume no responsibility for it. We have no obligation to monitor, review, screen, edit, or remove User Content, but we reserve the right to do so at our discretion and without notice.

Taste Champions are members whose guidance helps other members choose dishes. If you participate, you agree to share honest, first-hand experiences and to follow any program guidelines we provide. Contributors may receive recognition, status designations, features, or other benefits in connection with their participation. We may change, suspend, or end the Taste Champion program, or any status or benefit associated with it, at our discretion.

7. Artificial intelligence and the TasteScore

The Service uses artificial intelligence. Outputs generated or assisted by artificial intelligence — including recommendations, TasteScores, confidence and evidence indicators, explanations, summaries, dietary classifications, and ingredient interpretations — are predictive estimates only. They may contain inaccuracies, omissions, outdated information, incorrect assumptions, or fabricated information sometimes called "hallucinations." They must not be relied upon as statements of fact or as the sole basis for any dining, health, dietary, or purchasing decision.

The TasteScore™, together with its confidence number, evidence indicators, tier labels, bands, and any related explanations (collectively, the "TasteScore"), is a predictive estimate provided for informational purposes only. It is not a guarantee of satisfaction and may be inaccurate, incomplete, or out of date.

The TasteScore does not evaluate, represent, or account for food safety, allergen presence or risk, allergen cross-contact, nutritional quality, ingredient accuracy, caloric content, or suitability for any medical condition or dietary restriction.

We make no representation or warranty that the Service will accurately predict individual tastes, improve dining experiences, identify suitable menu items, or produce any particular outcome.

8. Menu, restaurant, and third-party information

Menus, recipes, ingredients, preparation methods, prices, availability, portion sizes, nutrition information, dietary labels, and allergen information may change at any time without notice. Information in the Service may not reflect real-time menu changes, ingredient substitutions, recipe modifications, pricing updates, availability changes, or discontinued items.

Information displayed in the Service may be supplied by restaurants, by users, or by public sources, or may be generated or interpreted with the assistance of artificial intelligence. We do not independently verify menu items, ingredients, recipes, substitutions, nutrition information, dietary labels, or kitchen practices. Any nutrition or dietary information shown is reproduced from third-party sources for convenience only and has not been verified, calculated, or certified by Guch.

Restaurants are solely responsible for their menus, ingredients, recipes, substitutions, preparation methods, allergen disclosures, nutrition information, food safety practices, labeling, regulatory compliance, and all food and beverage they serve. We do not control restaurant operations.

We are not responsible for inaccuracies, omissions, delays, synchronization failures, or incomplete information provided by any third party, including restaurants, reservation platforms, point-of-sale systems, delivery platforms, menu providers, and mapping or location providers. The Service may link to or interoperate with third-party websites and services; your use of those is governed by their own terms.

9. Food allergies, dietary restrictions, and assumption of risk

NO RECOMMENDATION, DIETARY TAG, SEARCH FILTER, TASTESCORE, EVIDENCE INDICATOR, COMMUNITY REVIEW, OR OTHER CONTENT IN THE SERVICE SHOULD BE RELIED UPON TO DETERMINE WHETHER A DISH IS SAFE FOR YOU TO CONSUME OR APPROPRIATE FOR ANY MEDICAL CONDITION OR DIETARY RESTRICTION.

We cannot verify restaurant practices — including the use of shared equipment, preparation surfaces, fryers, cooking oils, utensils, or storage — and therefore cannot assess or exclude the risk of allergen cross-contact. Restaurants may change ingredients or make substitutions at any time without notice.

Do not rely on TasteFit as your sole or primary source of information when making decisions involving:

Food allergies
Celiac disease or gluten-related disorders
Food intolerances or sensitivities
Medically prescribed or restricted diets
Religious dietary requirements
Pregnancy-related dietary restrictions
Lifestyle or personal dietary preferences
Any other condition affected by food ingredients, additives, or preparation

Always contact the restaurant directly, clearly communicate your requirements to staff, and independently confirm ingredients and preparation practices before ordering or consuming any dish. If adequate information is not available, do not assume a dish is safe based on anything displayed in the Service. Consult a qualified healthcare professional regarding any medical or dietary condition.

Assumption of risk. You acknowledge that selecting and consuming food involves inherent risks that exist independently of the Service, including allergic reactions, foodborne illness, ingredient substitutions, inaccurate or incomplete menu information, dietary non-compliance, and preparation errors. To the fullest extent permitted by applicable law, you voluntarily assume those inherent risks and are solely responsible for independently verifying any information material to your health, safety, dietary needs, religious observance, or purchasing decisions before ordering or consuming any food or beverage. This paragraph does not apply to, and you do not assume, any risk arising from Guch's own gross negligence, recklessness, willful misconduct, fraud, or violation of law.

10. Acceptable use

You agree to use the Service only for lawful purposes. You agree not to:

Post content that is unlawful, fraudulent, misleading, defamatory, infringing, harassing, hateful, or obscene
Misrepresent a dining experience, or post a review of a dish or restaurant you have not personally experienced
Post or accept payment or other consideration in exchange for a review, reaction, or endorsement
Impersonate any person or misrepresent your affiliation with any person or entity
Attempt to manipulate, reverse-engineer, probe, or game TasteGraph, the TasteScore, ranking, or any scoring or trust system
Scrape, crawl, harvest, or use automated means to access or extract data from the Service
Interfere with, disrupt, or place undue load on the Service or its infrastructure
Use the Service to develop a competing product or to train a machine learning model
Access the Service through unauthorized means or circumvent any access or usage limit

We may investigate suspected violations and take any action we consider appropriate, including removing content and suspending or terminating accounts.

11. Intellectual property

The TasteFit name and logo, TasteGraph™, the TasteScore, and the Service's design, software, text, graphics, and compilations of data are owned by Guch Inc. or its licensors and protected by copyright, trademark, trade secret, and other laws. This includes, without limitation, our recommendation engine, machine learning models, algorithms, scoring methodologies, weighting systems, confidence calculations, ranking systems, analytical processes, and related software and proprietary technology, whether or not patentable. These Terms grant you no right to use our branding without our prior written permission.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes.

12. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to legal@guch.ai, addressed to our designated agent, Legal Department, Guch Inc. Your notice must include the information required by 17 U.S.C. § 512(c)(3). We may remove content and terminate the accounts of repeat infringers.

13. Reporting inaccuracies

If you believe information in the Service is inaccurate or out of date, you may report it through the app or through our contact form. We appreciate these reports, but we assume no obligation to review, investigate, verify, correct, or respond to any report, and no report creates any duty of care on our part.

14. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUCH INC. AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS PROVIDE THE SERVICE AND ALL CONTENT, RECOMMENDATIONS, TASTESCORES, EVIDENCE INDICATORS, AND THIRD-PARTY INFORMATION ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE MAKE NO WARRANTY THAT THE SERVICE OR ANY INFORMATION IN IT IS ACCURATE, COMPLETE, CURRENT, RELIABLE, SECURE, UNINTERRUPTED, ERROR-FREE, SAFE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, INCLUDING ANY HEALTH, ALLERGY, OR DIETARY PURPOSE.

15. LIMITATION OF LIABILITY

15.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GUCH INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR RELIANCE ON, THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF GUCH INC. AND ITS AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNTS, IF ANY, THAT YOU HAVE PAID TO GUCH IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15.3 Exceptions. The exclusions and limitations in Sections 15.1 and 15.2 do not apply to, and nothing in these Terms limits or excludes, liability for: (a) death or personal injury; (b) gross negligence, recklessness, or willful misconduct; (c) fraud or fraudulent misrepresentation; (d) violation of law; or (e) any other liability that cannot be excluded or limited under applicable law.

15.4 Subject to Section 15.3, the limitations and exclusions in this Section apply regardless of the legal theory asserted and even if any limited remedy is found to fail of its essential purpose.

16. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Guch Inc. and its affiliates, officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to (a) Your Content, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

This obligation does not apply to any claim to the extent it arises from Guch's own negligence, willful misconduct, or violation of law. We will give you prompt written notice of any claim for which we seek indemnification and reasonable cooperation at your expense. You may not settle any claim in a way that imposes an obligation or admission on Guch without our prior written consent.

17. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service, its members, or Guch. Where practicable and lawful, we will give you notice and an opportunity to cure.

Sections 2, 5 (as to the license granted), 6 through 9, and 11 through 23 survive termination.

18. Resolving disputes

18.1 Contact us first. Before starting a lawsuit, you and Guch agree to try to resolve the dispute informally. Send a written Notice of Dispute to legal@guch.ai describing the dispute and the relief you seek. We will do the same by sending notice to the email address associated with your account. If the dispute is not resolved within sixty (60) days, either party may proceed. This step is a condition to filing suit, and the applicable statute of limitations is tolled while it runs.

18.2 Preserved rights. Nothing in this Section prevents you from bringing a qualifying individual claim in small claims court or from reporting a matter to any government agency.

19. Governing law and your state-law rights

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Other than a small claims action, you and Guch agree to the jurisdiction of the state and federal courts located in Chester County, Pennsylvania.

Nothing in these Terms deprives you of the protection of any consumer-protection or other law of the state where you reside that cannot be waived by agreement. The exclusions and limitations in Sections 14, 15, and 16 apply to you only to the extent the law of your state permits, and where a provision of these Terms conflicts with a non-waivable law of your state, that law controls as to you and the remainder of these Terms continues to apply.

California residents. Under California Civil Code section 1789.3, California users are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.

20. Apps distributed through app stores

If you obtained the TasteFit app through the Apple App Store or Google Play:

These Terms are between you and Guch Inc. only, not with Apple Inc. or Google LLC. Guch, not Apple or Google, is solely responsible for the app and its content.
Apple and Google have no obligation to provide maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Guch, not Apple or Google, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal requirements, and claims arising under consumer protection or privacy law.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

21. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top and notify you in the app or by email. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the updated Terms. Where applicable law requires it, we will ask you to affirmatively accept the updated Terms. Non-material changes take effect when posted. Changes do not apply retroactively to any dispute that arose before the change took effect.

23. General

Entire agreement. These Terms are the entire agreement between you and Guch regarding the Service and supersede any prior agreements on this subject.

Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be. The remaining provisions stay in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

No third-party beneficiaries. Except as stated in Section 20, these Terms create no third-party beneficiary rights.

Headings. Headings are for convenience only and do not affect interpretation.
